The new piracy: how West 'steals' Africa's plants

Swiss and British firms are accused of using the scientific properties of plants from the developing world to make huge profits while giving nothing to the people there. Antony Barnett reports

The Busy Lizzie is one of the most popular plants among British gardeners, providing instant colour to even the most challenging flower beds. Yet this humble plant now finds itself caught up in an international row over patents, human rights and the exploitation of poor communities in the developing world.

The launch of a new strain of 'trailing' Busy Lizzie by the multinational biotech giant Syngenta is, say campaigners, a classic example of what they have dubbed 'biopiracy'. This term is being increasingly used by environmental groups to describe a new form of 'colonial pillaging' where Western corporations reap large profits by taking out patents on indigenous materials from developing countries and turning them into products such as medicines and cosmetics which can be extremely valuable in western markets. In very few cases are any of the financial benefits shared with the country of origin.

An analysis by The Observer of patents issued by the British authorities reveal they have granted several companies patents for at least seven products that orginated from naturally occurring African plants or organisms.

The dispute over the Busy Lizzie revolves around the drive to create the perfect hanging basket display, a demand which feeds a lucrative market for the horticultural industry. Despite its massive popularity the Busy Lizzie - or Impatiens walleriana - has always had one downside: it is too upright.

For years botanists had been hunting for a way to make Busy Lizzies trail downwards. Researchers believed that if they could find this magic extra, the plant would be ideal for hanging baskets and a botanical gold mine would be theirs for the taking.

With great fanfare in April last year Syngenta launched the Spellbound Busy Lizzie. The company claimed that 'after many years of research' it had produced a Busy Lizzie that 'can achieve, at maturity, trails of 70cm [about 28 ins with] masses of large flowers throughout the summer until the first frost'.

The Spellbound went on sale at garden centres across North America and Europe for £2 a plant and Syngenta promoted it through retailers such as B&Q and Wyevale Garden Centres with its own mascot: Lizzie the Spellbound Fairy. It was a great commercial success and more varieties have been launched.

But behind the marketing glitz and talk of magical creatures, an analysis of the British patent taken out by Syngenta for its new floral 'invention' reveals that Spellbound's magical secret comes from a rare African plant, the Impatiens usambarensis. This grows in the unique ecological habitat of the Usambara mountain range in Tanzania, just south of Mount Kilimanjaro. In its patent Syngenta describes this plant as having 'no commercial significance'.

Syngenta's botanists discovered that by crossing the two plants, the Busy Lizzie displayed the much sought after 'trailing growth habits'. Despite admitting that such hybrids happened naturally in Tanzania, Syngenta claimed the new plant was its 'invention' and the British authorities granted the company a patent on 6 February 2004.

The patent reveals that Syngenta obtained the seeds of the African plant from the Royal Botanical Gardens in Edinburgh that had cultivated them 'from a wild collection from Tanzania'. A botanical gardens spokeswoman said it had received the seeds in 1982 from the Royal Botanical Gardens at Kew. They had been deposited there in 1976 by Christopher Grey-Wilson, a former president of the Alpine Garden Society.

'This appears to be a classic case of biopiracy,'
says Alex Wijeratna, a campaigner from ActionAid.
'This is the silent plunder of natural resources from developing countries. Here we have a large multinational taking out a patent on a plant that grows naturally in a part of Africa and claiming it is their invention . Now the company is making a fortune selling it to the mass market, but the Tanzania communities that live in these regions will not receive one penny.'

In 1994 more than 100 countries, including Britain, signed the International Convention on Biological Diversity that promised to recognise the property rights of developing countries. It did not prohibit the collection of indigenous material but recommended that agreements should be reached to share any commercial benefit that later emerges.

A Syngenta spokesman admitted it had paid nothing for the seeds. He said: 'We got them in 1990 before the international convention came into force. In any case our paperwork shows that when we received the seeds nobody knew exactly which country they came from.'

He rejects the claim of biopiracy. 'Many plants that grow today in a British garden originate from another part of the world and I would not describe that as a type of piracy.'

The US-based Edmonds Institute recently published a report listing more than 30 example of western medical, horticultural and cosmetic products it alleged had been 'pirated' from Africa. An analysis of these patents by The Observer reveals that the Syngenta patent is one of seven granted by the UK authorities that now face accusations of biopiracy.

These include:

· A diabetes drug being developed by a British firm that comes from the Libyan plant Artemisia judaica

· An immuno-suppressant drug being developed by GlaxoSmithKline that comes from a compound found in a termite hill in Gambia.

· A treatment for HIV taken from mycobacteria discovered in mud samples from the Lango district of central Uganda.

· Infection-fighting drugs made from amoebas in Mauritius and Venezuela.

· An anti-diarrhoea vaccine developed from Egyptian microbes.

· A slug barrier made from a Somalian species of myrrh.

Although the development of such drugs is widely welcomed and the companies involved deny the accusations of biopiracy, there is a growing debate about whether profits should be shared between western companies and developing countries.

Beth Burrows, president of the Edmonds Institute, a non-profit body specialising in education about intellectual property rights, said:

'Times have changed. It is no longer acceptable for the great white explorer to trawl across Africa or South America taking what they want for their own commercial benefit. It is no more than a new form of colonial pillaging. As there are internationally recognised rights for oil, so there should be for indigenous plants and knowledge.'

The Brazilian ambassador in London, Jose Mauricio Bustani, described biopiracy as

'a silent disease'.
He said: 'It is hardly detectable, it frequently does not leave traces and is an elusive activity perpetrated and often abetted by many well-known multinational companies.

'Unfortunately, it does not attract the same media coverage or public outcry as other environmental problems, such as deforestation and pollutant emissions. But this silent pillage is robbing developing countries in Africa, Latin America and Asia of the means to finance important sustainable development projects, and is a powerful disincentive for their biodiversity conservation efforts.'

Five years ago The Observer became the first newspaper to reveal how the British drug firm Phytopharm had patented an active ingredient in a plant called hoodia. This is a cactus-like African plant that is used by the San bushmen in South Africa to ward off hunger before hunting trips. Phytopharm has linked with Unilever to market this product, now being developed, as a diet drug. Unilever has agreed to pay up to £21m to Phytopharm, which originally claimed the tribe was extinct.

The Observer article prompted an international outcry and lawyers representing the surviving African bushmen managed to forge a benefit-sharing agreement that will see the tribe collect a small share of any profits.

Yet Phytopharm's chief executive, Richard Dixey, strongly rejects the claims of biopiracy and accuses campaigners of scoring an own goal. He said: 'Biopiracy is such an emotive term for a highly complex issue. The fact is that many of these plants grow in more than one place and have been used by many people throughout history. It is almost impossible to discover who 'owns' them.

'In any case it takes a huge effort and a lot of money from recognising a particular property in a plant and developing it into a drug. It can cost between $200m and $500m [£100m-£250m]. If companies could not get the protection of a patent then they simply would not bother. Then what would happen is that the traditional knowledge of these communities would die out with the people or be lost as they become westernised.'

It is not just in the world of medicine and horticulture but also in fashion that the debate over biopiracy rages. In 2004, The Observer revealed how British scientists from Leicester University worked with US firm Genencor to patent a microbe that lives in the caustic lakes of Kenya's Rift Valley.

It was discovered that when jeans are washed with this, the microbe produces an enzyme that 'eats' the indigo dye, giving them a naturally faded look. The company, which denies any wrongdoing, has since made more than $1m in sales to detergent makers and textile firms.

Would you trust your government with the lives of your family? During a national emergency would you wait for help or make efforts to safeguard your family? The government devours roughly 40% from the average American family's budget through taxes and what services do they get in return? The proper role of government according to the constitution is to guard life, liberty and property. It is sad to say but if America was the name of a ship sailing upon choppy waters and our government officials knew we were headed for the ‘perfect storm'[1] they would be guarding the life rafts and jumping ship.

I could cite[2] so many different examples[3] showing that the government does not concern itself with the safety of Americans but if you are honest with yourself you know it as well as I do. The stark reality is that the politicians and monopoly men view the common man and woman like cattle. We are branded with names like ‘useful idiots' and ‘useless eaters' and of course they must thin the herd to ensure their own survival. This idea has been passed down from gangrenous minded individuals like Giammaria Ortes[4] and Thomas Malthus and many in this generation who want 80 percent of the world to be culled.

In 1961 Frederick S. Jaffe, then vice president of Planned Parenthood Federation of America (PPFA), sent a memorandum to Bernard Barelson, president of the Population Council, in which he proposed various measures to reduce U.S. fertility.

Social constraints would include postponing or avoiding marriage, altering the image of the ideal family size, compulsory sex education and family limitation, encouraging increased homosexuality, encouraging women to work and putting fertility control agents in the water supply.[5]

John D. Rockefeller and other so-called elites have taken great care to invest part of their fortunes into the eugenics and population control movement. They are responsible for pushing abortion under the name of ‘Planned parenthood'. John D. Rockefeller is also responsible for putting fluoride in the water supply which is causing spontaneous miscarriages. Fluoride has a disastrous effect upon the mind and body.

1953: In a joint speech, U.S. Surgeon-General Scheele and Health, Education & Welfare Undersecretary Nelson Rockefeller announced hopeful plans to put more medicine than just fluoride into the U.S. water supplies:

"Dr. Scheele, in discussing mass-application methods for preventing non-infectious diseases, said a case in point was fluoridation of water supplies to reduce tooth decay.

Nearly 800 cities throughout the country have adopted the technique during the past 10 years, he said. Such a community-wide attack on "far more serious diseases than dental decay" probably will be forthcoming after laboratory tests have paved the way, he predicted." (Paterson Evening News, 11/6/53)

Today some of the richest Americans such as Bill Gates[6] are actively participating in mass genocide[7]. They want to bring the one-child policy from China to America and they don't mind spending millions to get it done. The important question is what happens when the rat poison in our water supply, forced sterilizations and other methods to mass murder the populace isn't decreasing the population as fast as they had hoped? That is the question that keeps me up at night but I think I know the answer.

Over the past six months I have seen a most disturbing trend. The American economy is on its last leg as the dollar slides towards oblivion and the prices of food[8] have started to rise sharply. Farmers have been worried about Monsanto[9] and DuPont, as they are trying to corner the seed market. Both companies are producing ‘genetically modified crops' and you will be eating the Frankenfoods[10] regardless of what food you buy unless you buy your own seeds now and produce your own vegetables.

Food banks which supplies foods to our nations poor have recently been reporting critical shortages and some even closing down. Many of these food banks also provide food during national emergencies. Now Americans may face stagflation, a situation where prices rise but growth slows. Recently the Consultative Group on International Agricultural Research CGIAR)[11] released a report about the world's food situation while at the same time working in tandem with Bill Gates and the Rockefeller Foundation, Monsanto and DuPont to create a ‘doomsday'[12] seed vault in Norway. This seed vault will contain, "It will contain up to three million different varieties of seeds from the entire world, ‘so that crop diversity can be conserved for the future,' according to the Norwegian government."

We can only speculate as to the reasoning for this seed vault but their agricultural Noah's ark will not be for public consumption. Also these GMO frankenfoods may have catastrophic effects on our bodies and the environment. Warn your friend and families about GMO products and let's live off our own land like our forefathers.

Faults in the Arctic Seed Vault

not everyone is celebrating Svalbard

After months of extraordinary publicity, and with the apparently unanimous
support of the international scientific community, the "Global Seed Vault" was
officially opened today on an island in Svalbard, Norway. Nestled inside a
mountain, the Vault is basically a giant icebox able to hold 4.5 million seed
samples in cold storage for humanity's future needs. The idea is that if some
major disaster hits world agriculture, such as fallout from a nuclear war,
countries could turn to the Vault to pull out seeds to restart food production.
However, this "ultimate safety net" for the biodiversity that world farming
depends on is sadly just the latest move in a wider strategy to make ex situ
(off site) storage in seed banks the dominant – indeed, only – approach to crop
diversity conservation. It gives a false sense of security in a world where the
crop diversity present in the farmers' fields continues to be eroded and
destroyed at an ever-increasing rate and contributes to the access problems that
plague the international ex situ system.

Faulty assumptions

Cary Fowler, Director of the Global Crop Diversity Trust and one of the main
proponents of the Vault, says that the initiative "will rescue the most globally
important developing-country collections of the world's 21 most important food
crops." While it's true that crop diversity needs to be rescued and protected,
as irreplaceable diversity is being lost at an alarming scale, relying solely on
burying seeds in freezers is no answer. The world currently has 1,500 ex situ
genebanks that are failing to save and preserve crop diversity. Thousands of
accessions have died in storage, as many have been rendered useless for lack of
basic information about the seeds, and countless others have lost their unique
characteristics or have been genetically contaminated during periodic grow-outs.
This has happened throughout the ex situ system, not just in genebanks of
developing countries. So the issue is not about being for or against genebanks,
it is about the sole reliance on one conservation strategy that, in itself, has
a lot of inherent problems.

The deeper problem with the single focus on ex situ seed storage, that the
Svalbard Vault reinforces, is that it is fundamentally unjust. It takes seeds of
unique plant varieties away from the farmers and communities who originally
created, selected, protected and shared those seeds and makes them inaccessible
to them. The logic is that as people's traditional varieties get replaced by
newer ones from research labs – seeds that are supposed to provide higher yields
to feed a growing population – the old ones have to be put away as "raw
material" for future plant breeding. This system forgets that farmers are the
world's original, and ongoing, plant breeders. To access the seeds, you have to
be integrated into a whole institutional framework that most farmers on the
planet simply don't even know about. Put simply, the whole ex situ strategy
caters to the needs of scientists, not farmers

In addition, the system operates under the assumption that once the farmers'
seeds enter a storage facility, they belong to someone else and negotiating
intellectual property and other rights over them is the business of governments
and the seed industry itself. In the case of most so-called public genebanks,
the seeds are said to become part of "the public domain" if not "national
sovereignty" (which increasingly translates to state ownership). The
Consultative Group on International Agricultural Research (CGIAR), which runs
about 15 global genebanks for the world's most widely used staple food crops,
has even set up a legal arrangement of "trusteeship" that it exercises over the
treasure chest of farmers' seeds that it holds "on behalf of" the international
community, under the auspices of the FAO. Yet they never asked the farmers whom
they took the seeds from in the first place if this was okay and they left
farmers totally out of the trusteeship equation.

The new Svalbard Vault lies squarely at the pinnacle of this faulty architecture
and false assumptions, inevitably exacerbating these problems. Because it is a
"doomsday" backup collection, it raises the stakes to new extremes. Nobody
really knows for sure if the Vault will be effective in keeping the seeds alive
and its security is untested. Just days before the opening of the Vault,
Svalbard was at the centre of the biggest earthquake in Norway's history, even
though the facility's feasibility study assured that "there is no volcanic or
significant seismic activity" in the area. But more troubling than any technical
matter is the issue of access, the keys to which are held by few hands.

Access and benefit ills

The Vault is not immune from the terrible controversies over access to and
benefits from the world's precious agricultural biodiversity. The Norwegian
government is ultimately responsible for the Vault and is currently regarded as
fair and trustworthy, but there is no guarantee that the country's policies
won't change. This is acknowledged by the Norwegian government itself, which has
provided agreements to be signed with depositors that last only ten years and
that include clauses allowing them to be terminated if policies change. Probably
more important, the Norwegian government will not be making decisions
autonomously. Decisions will be shared with the Global Crop Diversity Trust, a
private entity with strong private and corporate funding.

There are already some access issues with the Vault. For all practical purposes,
seeds cannot be stored in the Vault unless they come from genebanks that have
successfully duplicated their samples in another bank. More than this,
depositors are not allowed to put in seeds that are already stored in the Vault.
The Standard Depositor Agreement states that the "Depositor shall deposit only
samples of plant genetic resources that are, to the best of the Depositor's
knowledge,.. samples of plant genetic resources that have not yet been deposited
in the Svalbard Global Seed Vault" and that "the Depositor recognizes the right
of the Royal Norwegian Ministry of Agriculture and Food to refuse to accept
samples for deposit or to terminate the deposit of samples already deposited if
the samples constitute duplicates of materials already held in deposit in the
Svalbard Global Seed Vault".

As a rule, only depositors can access their own collections at Svalbard, or give
permission for someone else to. With parcels of CGIAR seeds already arriving in
Norway, this means that the CGIAR Centres will be the depositors for most of the
seeds held in the Vault, giving them almost exclusive control over access.
Indeed, as the Seed Vault feasibility study indicates, it was "assumed that the
[Vault] would begin operations with a nucleus consisting of the CGIAR materials
and those of certain key national genebanks and that this (sic) 'founding
collections' would discourage subsequent unnecessary duplication of materials
within the Svalbard facility." Out of the 19 depositor institutes that have
registered with the Vault so far, only three are national seed banks from
developing countries. The Vault, then, is not a safe deposit box for just
anyone. It is mostly the CGIAR's private stash.

In practical terms this means that many developing countries that want to
duplicate their collections in Svalbard would not be able to do so directly. It
would be seen as a duplicate of what the CGIAR has already deposited. They will
not, therefore, have direct access to seeds in the Vault that may have been
collected from their country. This might not seem to pose many concerns right
now because governments have different backup sources for seeds but the context
would be vastly different under any doomsday scenario where decisions would have
to be taken over a critical, unique resource which suddenly only remains in
Svalbard. For farmers there is pretty much no possibility for direct access to
seeds in the Vault.

But doomsday aside, it is important to ask who really benefits from the ex situ
system that the Vault contributes to. As the few transnational seed corporations
that control over half the world's US$30 billion annual commercial seed market
are increasingly buying up public plant breeding programmes and governments are
pulling out of plant breeding, the ultimate beneficiaries will be the very same
corporations that are at the roots of crop diversity destruction.

Stop destroying diversity instead!

If governments were truly interested in conserving biodiversity for food and
agriculture, they would do two things. First, they would, as a central priority,
focus their efforts on supporting diversity in their countries' farms and
markets rather than only betting on big centralised genebanks. This means
leaving seeds in the hand of local farmers, with their active and innovative
farming practices, respecting and promoting the rights of communities to
conserve, produce, breed, exchange and sell seeds. But this won't happen until
governments turn agricultural policy and regulations upside down and stop
pushing for industrialisation and feeding corporate-controlled global markets at
the expense of letting farmers freely feed their own communities and countries.
This means making food sovereignty the foundation of farm policy instead of
continuously pushing agriculture further down the destructive path of
corporate-led global market integration.

Svalbard is about putting diversity away, in case of some hypothetic emergency.
The real urgency, however, is to let diversity live – in farms, in the hand of
farmers, and across people-controlled and community-oriented markets – today.
