Kucinich Pushes on Impeachment

Congress has plenty of evidence that George W. Bush deserves impeachment for misleading the nation into war in Iraq, authorizing torture and other grave crimes, and violating the Constitution – and it is now time to act, says Rep. Dennis Kucinich.

“How many more hearings do we need to have to prove this administration has violated the Constitution, taken the law into its own hands, and condoned torture?” asked Kucinich, D-Ohio, author of some three dozen articles of impeachment.

“These articles of impeachment are about accountability,” Kucinich said in an interview. “I think our country is at risk. We’re setting a terrible precedent for future administrations if we choose to turn a blind eye to the crimes committed by this administration.

“We need to send a message to the next President that if he conducts himself in a similar capacity it would be met with a response from the Congress that you are going to be held to account. … There is a point at which you reduce Congress to a debating society.”

Last month, Kucinich stunned colleagues when he introduced an impeachment resolution on the House floor and then spent nearly five hours reading the 35 articles, alleging that President Bush was guilty of a wide range of crimes.

The articles of impeachment were introduced a few days after the Senate Select Committee on Intelligence released a long-awaited report on prewar Iraq intelligence that concluded Bush and Vice President Dick Cheney knowingly misled the public and Congress about Iraq's links to al-Qaeda and the threat the country posed to the United States.

The House sidetracked Kucinich’s resolution by voting – 251-166 – to send it to the House Judiciary Committee. At the time, Kucinich said he expected Judiciary Committee Chairman John Conyers to hold hearings within a 30-day deadline Kucinich had imposed, but Conyers chose not to act.

On Thursday, Kucinich said he had whittled down the 35 articles of impeachment to a single article, alleging Bush “deceived” Congress into believing Iraq had weapons of mass destruction in order to get lawmakers to back a U.S.-led invasion of the country.

The one article was introduced by Kucinich on the House floor as a privileged resolution, which requires lawmakers to act on the measure within two legislative days.

‘Good Faith’

At a news conference, Kucinich said he understands “that many members of Congress voted in good faith to authorize the use of force against Iraq, and I understand that many in the media supported that action.

“When the President of the United States makes representations on matters of life and death, we all want to believe him and give him the benefit of the doubt. Trust is the glue which holds the fabric of our nation together. …

“We all know the consequences of the war, the loss of lives and injury to our troops, the deaths of innocent Iraqis, the cost to the American taxpayers. There has been another consequence: Great damage to our Constitution through an unnecessary, illegal war and the destruction of the superior role of Congress in the life of this nation.”

Kucinich said "Congress must, in the name of the American people, use the one remedy which the Founders provided for an Executive who gravely abused his power: Impeachment.”

In 2006, then-House Minority Leader Nancy Pelosi declared impeachment “off the table,” in part, to avoid alarming centrist voters. Now, House Speaker Pelosi is keeping the issue “off the table” as Democrats eye the possibility of larger majorities in November’s elections.

"Speaker Pelosi will continue to lead legislative efforts to find a new direction in Iraq but believes that impeachment would create a divisive battle, be a distraction from Congress's efforts to chart a new course for America's working families and would ultimately fail," Pelosi's spokesman, Nadeam Elshami, told the Cleveland Plain Dealer last month.

On Thursday, Pelosi shifted her stance somewhat by indicating that there is a strong possibility that the House Judiciary Committee may hold hearings on impeachment, but indicated that it’s still unlikely that the full House would take action on impeachment.

"This is a Judiciary Committee matter, and I believe we will see some attention being paid to it by the Judiciary Committee," Pelosi told reporters. "Not necessarily taking up the articles of impeachment because that would have to be approved on the floor, but to have some hearings on the subject."

Conyers's office did not return calls Thursday afternoon. In the past, the Michigan congressman said he did not support Democratic efforts to impeach President Bush. Last year, a resolution introduced by Kucinich to impeach Vice President Cheney died in Conyers's committee.

Iran Threats

Some leading Democrats have indicated they would back impeachment proceedings but only if President Bush authorized a military strike against Iran without first consulting Congress, according to a May 8 letter sent to President Bush by Conyers.

"Late last year, Senator Joseph Biden stated unequivocally that ‘the President has no authority to unilaterally attack Iran, and if he does, as Foreign Relations Committee chairman, I will move to impeach’ the President.

"We agree with Senator Biden, and it is our view that if you do not obtain the constitutionally required congressional authorization before launching preemptive military strikes against Iran or any other nation, impeachment proceedings should be pursued,” Conyers's letter said.

Kucinich said Conyers’s way of ensuring the administration does not launch a preemptive attack against Iran is illogical.

“The way to make sure [the Bush administration] doesn't attack Iran is to move forward with impeachment now,” Kucinich said in the interview. “We have an obligation to move forward now. We can't have this administration put us in a second war based on a similar approach.”

President Bush “misled the American people. He led us to believe Iraq posed an imminent threat. We cannot wait until they do something with Iran,” Kucinich said.

Kucinich said if Pelosi attempts to derail his efforts or if Conyers fails to hold hearings he would keep on introducing new articles of impeachment.

“I have informed the leadership of the House should they fail to hold hearings I would come back to the Congress in 30 days with even more articles,” Kucinch said.

“I may have to do this one or two more times before I get their attention and Congress starts to take this seriously. After I introduced this, there was discussion among the media that this is dead.

“Well, I hope they believe in life after death because I am coming back with this. Under a privileged resolution I can bring it up again and again and again. We cannot keep silent. We cannot allow the country to be lost to lies.”

WHEN THE COMMANDER IN CHIEF LIES TO GO TO WAR, HE MUST BE IMPEACHED

A SINGLE ARTICLE OF IMPEACHMENT WILL BE BROUGHT TO THE FLOOR ON THURSDAY; PLEASE CO-SPONSOR

Dear Colleague,



During the Fourth of July holiday a WWII veteran stood ram-rod straight in his crisp dress uniform and saluted our flag as it passed in a parade. His silent reverential stance was a powerful reminder of the love of country that is reflected in our veterans of all generations and all services.



It is also a powerful reminder of the responsibilities of the President of the Untied States in his capacity as Commander in Chief.



It is worse than heartbreaking that George W. Bush, as Commander in Chief, caused this country to go to war based on information which was false, and which he knew to be false. The consequences for our troops have been devastating. We have lost 4,116 of our beloved servicemen and women since the war began, with over 30,000 physically wounded and countless others emotionally wounded. The toll on the service persons and their families will be felt throughout their lives.



There can be no greater responsibility of a Commander in Chief than to command based on facts on the ground, and to command in fact and in truth. There can be no greater offense of a Commander in Chief than to misrepresent a cause of war and to send our brave men and women into harm’s way based on those misrepresentations.



There has been a breach of faith between the Commander in Chief and the troops. Iraq had nothing to do with 9/11 or with Al Qaeda’s role in 9/11. Iraq had neither the intention nor the capability of attacking the United States. Iraq did not have weapons of Mass of Destruction. Yet George W. Bush took our troops to war under all of these false assumptions. Given the profound and irreversible consequences to our troops, if his decision was the result of a mistake, he must be impeached. Since his decision was based on lies, impeachment as a remedy falls short, but represents at least some effort on our part to demonstrate our concern about the sacrifices our troops have made.



This Thursday evening I will bring a privileged resolution to the House with a single Article of Impeachment of President Bush for taking our nation and our troops to war based on lies. We owe it to our troops who even at this hour stand as sentinels of America because they love this country and will give their lives for it. What are we willing to do to match their valor and the valor of their successors? Are we at least willing to defend the Constitution from the comfort and security of our Washington, DC offices?

Dennis Kucinich said if hearings on the issue were not held within 30 days, he would introduce more articles of impeachment against Bush to the US congress. The House of Representatives voted on Wednesday to send Kucinich's impeachment bill to a committee in what has been seen as a delay tactic. The House Judiciary Committee is not likely to hold hearings before the end of Bush's term in January. The prospect of impeaching Bush was long ago declared "off the table" by Nancy Pelosi, a Democrat and the leader of the House. The House Judiciary Committee is chaired by John Conyers, a Democrat who had once vowed to hold impeachment hearings. Rule of law Kucinich, a Democrat, told Al Jazeera that the impeachment attempt was not just about the past, but also about the future. The bill also says Bush mishandled the response to Hurricane Katrina [EPA] "If we do not establish that the rule of law must apply to the president of the US now, what we are doing is through our inaction creating a precedent that would let the next president know that he could go ahead and wage war without congressional approval. "That he could approve of wiretapping, rendition, spying, torture or anything because congress wouldn't act. "We need to take a stand now not just for justice for what's happened over the last six, seven years but also to restrain any abuse of power in the next administration." Kucinich's articles of impeachment include charges that Bush manufactured a false case for going to war against Iraq. They also charge Bush with failing to provide troops with vehicle armour, illegally detaining both foreign nationals and Americans, condoning torture, mishandling the government's response to Hurricane Katrina and undermining efforts to address global warning. "It is imperative that members of congress have a thorough opportunity to read the articles of impeachment and study the documentation," Kucinich said in a statement. Embarrassing debate But an election looms in which every House seat, a third of those in the senate and the presidency are up for grabs. Consequently, with the legislative schedule shortened, House leaders are against spending the remaining time on impeachment proceedings. Republicans, seeing a chance to force Democrats into an embarrassing debate, voted to bring up the resolution, but the Democrats countered by pushing through a motion to scuttle the bill from the floor. Kucinich has tried before to impeach members of the Bush administration. Last year, he introduced a resolution to have Dick Cheney, US vice-president, removed from office. Republicans were forced to vote in favour of taking up the measure to force a debate, where the resolution was eventually killed.

Congressman Dennis Kucinich's resolution to impeach Vice President Dick Cheney now has more cosponsors signed onto it than any resolution to impeach President Richard Nixon ever had. But separate resolutions to impeach Nixon, some with a handful of cosponsors, many with no cosponsors at all, were filed by the dozens. Today, Kucinich's resolution stands alone.

Barbara Ellis wrote in a recent paper that has inspired a new strategy among advocates of impeachment, "

nearly 90 Democratic House members banded together to hopper separate bills to impeach Nixon. Two-thirds of them were to investigate whether Nixon's deeds rose to the level of Constitutional standards for impeachment; the other third were plain-vanilla articles of impeachment. In October alone, a flood of 40 bills were filed in that Democratic-controlled House."

Today there are 50 or 60 members of Congress who openly or secretly support impeachment or impeachment hearings for Cheney. There are 26 who have signed onto actual articles of impeachment (Kucinich's resolution), several others who have signed onto a letter to Judiciary Committee Chairman John Conyers urging impeachment hearings, several others who have made public comments suggesting they favor the hearings, and several more who signed on during the last Congress to Conyers' resolution to create a "preliminary impeachment investigation." Conyers has not reintroduced that bill.

A group of citizen activists from around the country has been meeting with members of Congress and their staffers to argue a case for recreating what they are calling the Nixon flooding plan. If, they argue, just the 30 or 40 members who are currently pushing for Cheney's impeachment were to file their own resolutions, the impact would be far greater than simply adding more names to Kucinich's bill or to a Dear Colleague letter. All that is needed, in other words, to move impeachment forward in the House might be for those who already claim to support it to put their printers where their mouths are and crank out a couple of dozen new bills.

In the Nixonian example, many of the bills introduced were very short and simple, and many were nearly identical to each other. Others picked out a few favorites from the list of available abuses by that president. In the case of Dick Cheney (or George Bush, for that matter), Congress Members could turn to the recent example of Congressman Jay Inslee's short and simple resolution to open an impeachment hearing on Attorney General Alberto Gonzales. (Thirty-two members got behind that bill, and surely more would have signed on had Gonzales not resigned. Now, Gonzales' replacement is repeating his crimes and abuses of power, but impeaching Mukasey would just highlight the fact that Bush and Cheney are giving the orders and that the Senate approved a clone of Gonzales as his replacement.) Beyond Gonzales-style resolutions that simply create hearings, pro-Constitution congress members could pick from a select menu of those abuses in which (unlike most of the Bush-Cheney abuses) Congress has not been complicit. These include rewriting laws with signing statements and proceeding to violate numerous statutes, refusals to turn over information, misleading Congress, refusals to comply with subpoenas, ordering former staffers not to comply with subpoenas, refusals to enforce contempt citations, commuting the sentence of a former top staffer who obstructed an investigation that involved Cheney and Bush, exposure of an undercover agent as punishment for a whistleblower, running a secret energy task force in violation of open-government laws, profiting through no-bid contracts to a war profiteer, election fraud, and the criminally negligent response to Hurricane Katrina.

Barbara Ellis, the author of the paper excerpted above, is an impeachment activist in Oregon and a member of a group called the National Coalition of We the People. Three members of this group, Michael Greenman from Ohio, Marcia Meyers from Oregon, and Carl McCargo from Massachusetts, traveled to Washington, D.C., last week and met with 32 congressional offices, in some cases with members and in others with staff. They intentionally included among those they spoke with some of the leaders of the original Nixon Flooding Plan who are still in Congress: Pete Stark (CA-8), John Conyers (MI-1), William Lacy Clay (MO-1), David Obey (WI-7), and Charles Rangel (NY-19).

The group reported on their congressional visits: "The Nixon Flooding Plan was met with high interest from all of our 32 Congressional contacts as a practical strategy for helping them to live up to that oath of office. Using our networking knowledge of and confidence in the millions of Americans passionate about impeachment, we promised those who take up the Nixon plan national recognition and support and offered sample investigation/impeachment bills for their convenience in drafting such a bill. One constant heard from House members and/or their key staffers was their message: 'We need to hear from our constituents' about trying that multiple-bill approach.

"So the main effort we're launching is a drive in the national impeachment movement for a "National Call for Impeachment Bills." We'll focus on the week of March 16 - 22 to flood House members with our support for either bills on investigations for impeachment or articles of impeachment.

"One message House members need to hear is that participants in that Nixon plan were re-elected in 1974 (five are still in the House). Only two participants were not re-elected, but not because of hoppering an impeachment bill against Nixon. Republican Paul McCloskey lost to a Democrat; and Bill Roy ran for Senate. Not only did the Democrats control the House in 1973-75 (242-192-1)), but they added nearly 50 more members (291-144) three months after Nixon resigned."

Congressman Kucinich has drafted over 50 articles of impeachment against Bush, and he should be encouraged to introduce those soon. But he and every member of Congress should be encouraged to introduce their own favorite resolution with regard to Cheney, even if it's simply a proposal to hold impeachment hearings.

The week of March 16-22 is a week when Congress Members are home in the districts. It's also the five-year point in the occupation of Iraq. A number of impeachment groups led by Code Pink have already designated the 18th a day for impeachment events. Why not plan now to pay a visit to your congress member's local office that week? For starters, federal aid should be directed toward those communities with the heaviest concentrations of foreclosures and homeowners at risk. Aid should help cover public safety costs imposed by vacant homes. It should help defray budgetary shortfalls for public schools that lose property tax revenue.

Second, a federal loan modification program for struggling homeowners should prohibit the replacement loan’s principal balance from exceeding the property’s appraised value. It should convert the terms to a long-term, fixed-rate and fully amortizing loan. It should limit monthly mortgage payments, including taxes and insurance, to an amount based on the homeowner’s ability to repay.

Third, for those homeowners who do not have the income to qualify for new financing, a federally financed land bank should buy the property from the lender at a steep discount and rent it to the former homeowner.

And most important, the cost of the loan modifications must be borne by the lenders or, if the loans have been packaged into securities, the investors, who were in the best position to profit from and prevent the crisis. This would provide marketplace stability and be preferable to the loss incurred by the lender at foreclosure.

The foreclosure crisis is a calamity for individual homeowners and a worry to financial markets. And what’s worse, if lenders and investors are allowed to profit from their predatory lending without bearing the full costs, they’ll do it again.

Rep. Kucinich was the most courageous and honest of all the candidates in the race. He had the guts to call the Bush administration on all of it's law breaking, and to actually take a stand AGAINST them. His introduction of HR # 333 and HR # 799 to impeach VP Cheney showed real leadership. It's too bad the MSM never gave him the equal air time for his campaign to gain traction.

From supporting the Impeachment of VP Cheney, to not wanting to grant retroactive immunity to the telecoms for illegally spying on innocent Americans, to opposing torturing detainees, Guantanamo Bay, The Military Commissions Act, The Patriot Act... Dennis always demonstrated superior judgement, social and fiscal responsibility, and the moral sanity and clarity at a time when our nation has never needed these qualities more from its leaders.

Once again I'm amazed at the spineless Democrats becoming even MORE cowardly as the 08 Pres election approaches. Today, enough Senate Dems sided with the Republicans, thus caving in once again by not demanding no retroactive immunity to the phone company giants for being accomplices with the White House on its law breaking and Constitution shredding. Even though they have two thirds of the American voters on their side. They chickened out again! Just like they did with the continued Iraq War Funding just before the Washington holiday season break!

Both Sen Clinton and Sen Obama claimed to support no immunity, but when it came time to act and vote on this, neither had the conviction to cause, or courage, to actually VOTE no on the immunity. What a courageous, righteous stand for change, right? All talk, but no real action, rarely changes anything, if ever at all. Dennis would have certainly had the guts to vote no.
