Boyd Graves back in Ninth Circuit court; US special virus program again on trial

GRAVES WINS RIGHT TO APPEAL AIDS ORIGIN LAWSUIT
(San Diego, Ca.) In what some are calling a legal victory for government disclosure, the San Diego federal court today granted AIDS activist Boyd Ed Graves a right to appeal to the Ninth Circuit in San Francisco, California.
The federal court had ruled that Graves had not served the prior attorney general, (Gonzales) and dismissed his case "without prejudice". However, when Graves re-filed the new complaint, the federal court "rejected" the new complaint leaving Graves virtually no avenue to proceed, since the new complaint was never docketed by the court.
"The appeal will demonstrate to the higher court the lower court erred on two significant points. First, Defendant, U.S. Attorney General Gonzales, received the federal complaint and exhibits via certified mail, return receipt requested on or about May 17, 2007", said Graves. On this point alone the case should be returned to a fair minded jurist who intends to support the U.S. Constitution on behalf of the American people.
"Second, the original complaint was dismissed "without prejudice". The Court clearly errs in 'rejecting' the new complaint", he stated.
At issue in the case are the "missing progress reports" (#'s 14 and 15) of the U.S. Special Virus program (1962 – 1978). Many experts believe this federal program is the birthplace of HIV/AIDS. See, www.boydgraves.com/comments/.
Defendant National Cancer Institute's (NCI's) Dr. Alan S. Rabson, After we requested them, REMOVED those two progress reports from the archives of the NCI contrary to federal Freedom of Information Act law. The agency should be enjoined and compelled to replace the missing progress reports immediately and a global investigation into the U.S. Special Virus program get underway.
The missing progress reports are the end reports of the U.S. Special Virus program that persisted in the United States from 1962 – 1978. The fifteen progress reports are coordinated by a 1971 "research logic" flowchart of the secret federal program. The flowchart is first located at page 61 of progress report #8 (1971). This federal lawsuit seeks to strengthen the security of the U.S. Constitution and the homeland of the United States of America. I have an inalienable right to life. My government does not have a right to make HIV/AIDS as I read.
